Terms of service
Last updated: 2026-05-04. By using ClaimPack you agree to these terms. They apply alongside Portuguese consumer law (Lei 24/96, DL 24/2014 distance-selling regime, and your statutory rights as a consumer, which cannot be waived).
1 · Who we are
ClaimPack is operated by Oskar Zabik, sole trader (trabalhador independente) based in Portugal. General contact: hello@claimpack.pt. Privacy and data-protection contact: privacy@claimpack.pt.
For service of legal process or any matter that requires a postal address, request it from hello@claimpack.pt and we will provide it directly. Tax identification (NIF) appears on invoices issued by our payment processor (see §6).
2 · What ClaimPack is — and is not
What we are:
- A guided intake and document-assembly tool that takes the facts you provide and produces a structured case file, a formal notice letter (interpelação admonitória) drafted from a template that carries the elements Portuguese law and case law require, and a routing recommendation, in the context of Portuguese empreitada disputes (Civil Code arts. 1207–1230) for residential consumers. You author the letter on your own behalf and decide whether to send it.
- A tool that uses publicly available Portuguese registries (NIF/NIPC, IMPIC) to validate contractor identification.
What we are not:
- A law firm. We are not registered with the Ordem dos Advogados as a sociedade de advogados.
- A provider of legal advice on your specific case. We assemble; we do not decide.
- A guarantor of any specific legal outcome. We do not promise to recover money, win cases, or reach any particular result.
- A representative in court, arbitration, or before any administrative authority.
Under Lei 10/2024, de 19 de janeiro, the acts reserved to advogados/solicitadores apply when exercised in the interest of third parties. ClaimPack is a tool you use on your own affairs: you supply the facts, you sign the letter, you send it. Lawyer review of templates is not required for you to operate this way, and applying the templates to your specific situation is your responsibility — alone or with a lawyer of your choice.
3 · Eligibility
You may use ClaimPack if:
- You are at least 18 years old;
- The property concerned is residential and located in Portugal (mainland, Açores, or Madeira);
- The dispute is with a contractor who acted as a professional;
- You are using the service for your own dispute (not as an intermediary or for someone else without their consent).
If your situation is outside scope, the diagnostic will tell you and direct you to the right professional.
4 · Account and security
Accounts use email-only magic-link authentication (no password). You are responsible for keeping the email account associated with your ClaimPack account secure. Notify us immediately if you suspect unauthorized access.
5 · Free-tier limits
To prevent abuse, the free tier is limited to:
- 100 chat turns per case
- 50 documents per case (max 100 MB total per case)
- 2 WhatsApp imports per case
- 30 turns per hour
We may adjust these limits with reasonable notice. We will not retroactively reduce limits for cases already in progress.
6 · Pricing, payment, and refund
Pricing is shown on the pricing page. Payment is processed by Polar (Polar Software Inc., DBA Polar.sh), our Merchant of Record for Portugal. Polar issues invoices and remits Portuguese VAT to the Portuguese tax authority on our behalf.
Refund: within 14 days of payment, we will refund without questions on email request to pagamentos@claimpack.pt. This is alongside, not in place of, your statutory right of withdrawal under Portuguese DL 24/2014 art. 10. After 14 days, refunds are discretionary; we will consider them in good faith.
7 · Your responsibilities
You agree to:
- Provide accurate information in the diagnostic and intake;
- Have lawful possession of (or consent to upload) any documents and media you submit;
- Not upload content that infringes others' rights or contains malware;
- Use generated documents in accordance with Portuguese law and these terms;
- Not misrepresent the documents we generate as having been produced by a lawyer or law firm.
8 · Intellectual property
You retain ownership of the data and materials you upload. We grant you a perpetual, non-exclusive licence to use the documents we generate for your own dispute. The templates underlying those documents remain our intellectual property; you may not reproduce them as templates of your own.
9 · Liability
Nothing in these terms limits liability that cannot be limited under Portuguese law (in particular, statutory consumer rights under Lei 24/96 and DL 84/2021).
Subject to that, our total liability for any claim arising from your use of ClaimPack is limited to the amount you paid us in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages, and for outcomes of any proceedings you bring against your contractor.
We are not liable for the contractor's failure to comply with a notice, for tribunal decisions, or for delays in postal services.
10 · Termination
You can close your account at any time from the product UI or by emailing us. We may suspend or close accounts that violate these terms; for material violations, we will give notice and an opportunity to cure where possible.
11 · Governing law and disputes
These terms are governed by Portuguese law. The Portuguese courts have non-exclusive jurisdiction. As a consumer, you may also bring an action in the courts of your country of residence within the EU.
For consumer disputes, you may use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr, or contact a Centro de Arbitragem de Consumo competent for your district. We are happy to participate in alternative dispute resolution.
12 · Changes
We may update these terms with reasonable notice (typically by email and an update to the "Last updated" date). Material changes will not affect refunds or rights for purchases already made.
